TERMS AND CONDITIONS
By agreeing to these Terms and Conditions, ‘you’ the customer/client/website user agrees with ‘us/we’ Festive Illuminations Ltd to be bound by these terms. If you do not accept these terms, you may not confirm an order with us.
These terms for the sales of goods governs any contract for sale that Festive Illuminations Ltd enters into with you. Your statutory rights are not affected.

1. Orders & Payment
We use a software system (Tradify) to log all orders, accessible via our staff upon installation. All invoices and quotes are sent from our software system, limited payments are accepted on this system. The customer takes responsibility for providing us with the correct installation/delivery address and installation/delivery contact details upon initial completion or confirmation of order.
The e-commerce website is not directly linked to our system software, details are manually, therefore details must be correct upon ordering.
Orders are not guaranteed via text, social media, phone call or voicemail. Orders must be placed by the proper channels to be guaranteed. Orders may be placed via the website, via email or paper form for limited areas instructed to do so. If you are unsure if your order has been placed, contact us.
Estimates are valid for 30 days from the email sent date.
Festive Illuminations Ltd is VAT registered, VAT will be added to all orders at checkout, if ordering online. If you require a VAT receipt, please contact eloise@festiveilluminations.info .
Payment is due on receipt of invoice or order. We the have the right to refuse an installation/delivery if payment has not been received prior to installation, unless agreed upon.
Where you are represented by a third-party person or company (e.g friend, family, neighbour, landlord, tenant, contractor or other representative), the third-party will be responsible for payment (if not already settled) and signing off installation.
We do not have a card machine, therefore cannot accept payments over the phone or on installation. We accept bank transfers, limited payments via invoice link and payments through our e-commerce website.
You will not be able to cancel your order once made, trees are perishable items, and no refunds will be given under any circumstances. Our supplier cuts the trees to order, we do not carry surplus stock, thus when your order is placed, we cannot guarantee to resell the order to another customer.
2. Ordering Online
To be eligible to purchase products/services on our website and lawfully enter into and form contracts on our website under English law you must:

Be over the age of 18 years

Register by providing your real name, phone number, email address, payment details and other
requested information.

Stipulate an installation/delivery address in the United Kingdom. Please note that PO box numbers,
hotels and accommodation addresses are not acceptable.

Possess a valid credit or debit card.
Ordering online will not issue an immediate invoice/receipt, however you should receive a confirmation email. It is the responsibility of the client to contact Festive Illuminations Ltd if an invoice/receipt is required.
3. Pricing
We remain the right to refuse an order if the customer orders under the incorrect area pricing. We offer varied pricing, working from the company’s location and efficiency of installation based on mass orders.
Our price structure is shown on the website and before checkout is complete, you will be given the opportunity to check price and delivery before confirming the order.
Whilst we make every effort to ensure our prices are correct, there may be occasions when we discover that a product has been mispriced. In such instances, the product will be removed from sale and the price corrected. In such circumstances, we would not be able to honour the incorrect price. Festive illuminations Ltd reserve the right to change any advertised prices at any time.
When an order has been placed using the website you will receive an email confirmation automatically. This will confirm that the order has been received and is about to be processed. Your order is guaranteed at this stage.
4. Natural Products
Our external trees are Norwegian Spruces, sourced locally from a recognised BCTGA grower and are 5-6ft in height. Our standard internal trees are Nordman Firs, also known as ‘non-drop’ trees. The external trees shed minimal needles as the low temperature keeps the moisture in the trees.
We supply real British grown natural, hand-pruned, trees, which differ in size and shape, all sizes and measurements are approximate. Upon ordering, you accept the knowledge that these are natural products and understand each tree differs from the next.
Our installation team will endeavour to choose the most similar trees where installing multiple trees for one set-up.
We remain the right to refuse a refund/exchange based on the tree size or shape being drastically different to images on our website, or from previous year installations.
We guarantee all of our trees and products are fit for purpose upon installation.

5. Fixings and Lighting
All standard set-up lights are powered by a 13-amp transformer, plugged into a standard 13-amp indoor socket. All lights and transformers are new, under 12 months old. We are not responsible for the electrical supply that we plug into. The customer is responsible for supplying a waterproof and safe socket for us to plug into.
We use unobtrusive temporary fixings on external trees. Our staff drill two 10mm holes into the façade at the point of fixing. 99% of our previous clients are happy for us to leave the fixings in for the next year, but we can remove them on request. We can fix into almost any material except for slate and tile. We regularly fix into listing buildings with owner consent.
Our standard external set-up uses warm white 200-bulb low voltage LED fairy lights. The lights use minimal electricity to run 24/7 for the 6 weeks of installation. We advise clients to leave lights on to get the full effect of our service, our staff will advise you to not touch the transformer once plugged in. Our lights have a multi-function transformer, once switched off, it may resent to another setting aside from constant.
It is the customer’s responsibility to reset this. If the customer wishes the setting to be on multi-function, then they should let a staff member know on installation or email us.
The lights, the trees, the stands, and fixings remain the property of Festive Illuminations Ltd.
6. Installation, Sign Off and Take Down
We install trees all around West Sussex, in time for the corresponding area’s ‘Light Switch On’. Please see your area for installation dates on the website or get in touch to find out when we will be in your area. We may not be able to install a tree for you when in the area if you order late, due to scheduling.
When you place an order for our standard external set-up, we will be in contact about your delivery/installation date. You are not able to choose this, however, if you have a specific date you need us to install by/after, please do not purchase through the website but contact us direct by email. We reserve the right to change or alter your install and delivery date at any point.
We install in over 30 Towns and Villages in Sussex, over a limited 4-week period, therefore operate a tight schedule to complete all installations. Once we have completed an area, it is not guaranteed we will return for late orders. We cannot guarantee individual installation date/times for every order, due to differing factors out of our control, including quantity of orders in an area, issues with installations, traffic, staffing etc.
If you are out when we are in your area to install, our staff will endeavour to contact you via contact details provided at point of ordering. If you are out, they may not install your order at that point and contact you to rearrange another date.
Our installation staff will ask you or your third party to sign off the installation. We aim to take down all the trees within ’12 days of Christmas’.
We reserve the right to refuse the supply of goods at our discretion.
If for any reason that goods may take longer than your expected installation/delivery date to be in your receipt, we will notify you.
7. Photos and Media Usage
We have several photographers visiting Christmas tree locations to take photos during December/January. These photos may be used in printed media, website and social media. These are usually street shots, and not directly of a property where an address/location can be identified.
Where we are tagged/mentioned on social media (@festivelluminations) these images may be re-shared, or used for media and website usage at our discretion.
8. Issues & Callouts
It is your responsibility to contact us if there is an issue as soon as it is detected/noticed. Often, small issues such as flashing lights can be dealt with instruction over the phone. Callout charges may apply, if the issue is detected as vandalism or for an unnecessary callout.

9. Landlord Permissions
You will need landlord’s permission for us to install a Christmas Tree to the front of your building. This is down to the customer to gain this permission. If you place an order with us, we will assume you have permission.

10. Privacy Policy
Your personal information
By using our site, you consent to our privacy policy.
When ordering with us or registering to our website, as appropriate, you may be asked to enter your: name, e-mail address, phone number and address.
We collect information from you when you fill out a form. Your personal information is not passed to any third parties.

The information generated relating to our website is used to create reports about the use of the website. Google Analytics will store this information. A copy of Google Analytics privacy statement. Most browsers allow you to refuse to accept cookies. (For example, in Internet Explorer you can refuse all cookies by clicking “Tools”, “Internet Options”, “Privacy”, and selecting “Block all cookies” using the sliding selector.) We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
